Coming Soon. In California, workers who are injured on
the job must generally seek compensation for such injuries from administrative
judges employed by the California
Division of
Workers' Compensation pursuant to the
California Workers' Compensation Act.
However, a worker who is discriminated against because
of a disability which resulted from an injury at work may bring a lawsuit for
disability discrimination in a
California State Superior
Court under the California
Fair Employment and Housing Act. The
California Workers' Compensation Act does not prevent such
lawsuits. Similarly, an employee may sue his employer in a California State
Superior Court for injuries which result from his employer's failure to provide
him with a reasonable accommodation of his disability.
It is illegal for an employer to ask an applicant for
employment whether he has ever received workers' compensation.
